This Legal page governs your access to and use of AI Clatrix ("AI Clatrix", "we", "us", "our"), including our website, dashboard, APIs, and related services (collectively, the "Service").

1. Terms of Service

1.1 Agreement to Terms

By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.

1.2 Eligibility

You must be legally able to enter into a contract and comply with all applicable laws and regulations to use the Service.

1.3 Accounts & Access

  • You are responsible for account security and for all activity under your account.
  • You must provide accurate information and keep it updated.
  • You may not share credentials or allow unauthorized access.

1.4 Service Description

AI Clatrix provides WhatsApp-focused tools including (as available): contact import, messaging, team inbox and agent assignment, automation workflows, templates and personalization, integrations (Zapier, Google Sheets, webhooks), and analytics/reporting.

1.5 Trials, Subscriptions, Billing

  • Free trials: If offered, trials may convert to a paid plan unless canceled before the trial ends.
  • Billing: Fees, billing cycles, and plan limits are described on the Pricing page or order form.
  • Taxes: You are responsible for applicable taxes unless we state otherwise.
  • Non-payment: We may suspend or terminate access for overdue payments.

1.6 Customer Responsibilities (Messaging Compliance)

You agree that you are solely responsible for:

  • Obtaining all required consents/permissions to message contacts (including marketing/promotional messaging).
  • Providing required disclosures (e.g., business identity, opt-out instructions).
  • Complying with applicable privacy and marketing laws (e.g., TCPA, GDPR, CCPA/CPRA, local telecom and spam rules) and any platform policies related to WhatsApp Business messaging.

1.7 WhatsApp / Third-Party Platforms

  • The Service may depend on third-party platforms (including WhatsApp Business services and providers).
  • We do not control third-party platforms and are not responsible for outages, policy changes, or enforcement actions by third parties.
  • Your use of WhatsApp is also governed by WhatsApp's terms and policies.

1.14 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

1.15 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CLATRIX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO AI CLATRIX IN THE PAST 12 MONTHS.

2. Privacy Policy

2.1 What We Collect

Information you provide

  • Account info (name, email, company, billing details)
  • Support requests and communications
  • Configuration data (templates, tags, workflows)

Information you upload or generate

  • Contact data you import (e.g., phone numbers, names, tags, custom fields)
  • Conversation content and message metadata (e.g., timestamps, delivery/read status)
  • Analytics and performance metrics

Technical data

  • Device/browser data, IP address, logs, cookies, and usage data

2.2 How We Use Information

We use information to:

  • Provide, maintain, and improve the Service
  • Authenticate users and prevent fraud/abuse
  • Enable messaging, automation, analytics, and integrations
  • Provide customer support and communicate updates
  • Comply with legal obligations

2.4 How We Share Information

We may share information with:

  • Service providers (hosting, analytics, support tools) who process data on our behalf
  • Integration partners you enable (e.g., Zapier, Google Sheets, webhook endpoints you configure)

We do not sell personal information in the conventional sense.

2.6 Your Responsibilities (Customer Data)

You are responsible for:

  • Ensuring you have rights/consent to upload and message contacts
  • Providing required notices to your contacts
  • Handling opt-outs and preferences consistent with applicable law

2.9 Your Rights

Depending on your location, you may have rights to access, correct, delete, or export your personal data, and to object or restrict processing. Contact privacy@aiclatrix.com.

3. Acceptable Use Policy (AUP)

You may not use AI Clatrix to:

  • Send spam, deceptive, or unlawful messages
  • Message people without required consent/permissions
  • Harass, threaten, exploit, or harm others
  • Promote illegal goods/services or prohibited content
  • Transmit malware or attempt unauthorized access
  • Scrape, reverse engineer, disrupt, or overload the Service
  • Violate WhatsApp policies or other third-party platform rules

We may suspend/terminate accounts for violations and cooperate with lawful requests.

4. Cookies Policy

AI Clatrix uses cookies and similar technologies to:

  • Keep you signed in and maintain sessions
  • Understand site usage and improve performance
  • Secure the platform and prevent abuse

Cookie controls: You can adjust cookie settings in your browser. If you disable cookies, some features may not work properly.

5. Data Processing Addendum (DPA)

If you are a business customer and require a Data Processing Addendum (e.g., GDPR), contact privacy@aiclatrix.com to request our DPA.
